#TheChevroletRace Contest Rules and Regulations (“Rules”)

OFFICAL RULES AND REGULATIONS

This Contest is open to Canadian residents only and is governed by Canadian law.

Standard data rates apply to participants who choose to participate in the Contest via a mobile device. Please contact your service provider for pricing and service plan information and rates before mobile device participation.

  1. Contest Period:  #TheChevroletRace in partnership with “The Amazing Race Canada” contest (the “Contest”) is run by General Motors of Canada Company (the “Sponsor”) and will take place from July 5, 2022 at 10:00PM Eastern Time (“ET”) to September 25, 2022 at 10:00PM ET (the “Contest Period”).

  2. Contest Group:  For the purposes of the Contest, the “Contest Group” is composed of the Sponsor and its parent, subsidiary and affiliated entities, together with their respective dealers, franchisees, advertising and promotion agencies, suppliers of material and services related to the Contest, and any other corporation, partnership, sole proprietorship or other legal entity to the benefit of which this Contest is held, as well as their respective officers, directors, employees, agents, successors, assigns and other representatives.

  3. Eligibility:  The Contest is open to all individuals who: (a) are residents of Canada; and (b) have reached the age of majority in their province/territory of residence as of the date of entering the Contest. Employees, agents and other representatives of the Contest Group, Insight Production Company Ltd., or Bell Media Inc., as well as any person with whom they reside, are not eligible to enter the Contest. Important Note: without limiting any of the foregoing and any other winner confirmation requirements below, to be eligible to receive the Vehicle Prize (defined below), the confirmed winner must have a valid and unencumbered driver's license in the province or territory in which they reside and satisfactory insurance.

  4. How to Enter: No purchase necessary. Individuals may enter the Contest during the Contest Period as outlined below. No entries will be accepted by any other means.

    To enter the Contest, you will need to sign up for a Twitter account if you do not already have one. To sign up for a Twitter account, visit www.twitter.com and follow the onscreen instructions. Signing up for an account is free but is subject to acceptance of the Twitter Terms of Service which can be found at www.twitter.com. You may only use one (1) personal Twitter account to participate in this Contest. You must be able to receive direct messages from the Sponsor’s Twitter page to enter the Contest via Twitter, and ensure that your pre-populated reply tweets (as described below) can be received and viewed by the Sponsor.

    On or before the start of the Contest Period, the Sponsor will post a promoted call-to-action tweet about the Contest. At any time during the Contest Period, individuals must “like” the following tweet: “<3️ this Tweet to subscribe to #TheChevroletRace, our weekly #AmazingRaceCanada Twitter quiz. Every correct answer is your chance to win an All-Electric 2022 Chevrolet Bolt EUV. Tune in to The Amazing Race Canada on CTV every Tuesday at 9/8c for clues to help you win! #contest” in order to subscribe to receive the weekly quiz questions; individuals must be subscribed for the weekly quiz questions in order to be able to enter. Participants may unsubscribe to the quiz at any time (reply #stop to unsubscribe), which will not impact any quiz question responses submitted prior to unsubscribing.

    On Tuesday of each week during the Contest Period (with the first quiz question being posted on July 5, 2022 and the last quiz question being posted on September 20, 2022, for a total of eleven (11) quiz questions during the Contest Period), subscribed participants will receive a tweet with the weekly quiz question (each question relating to the most recent episode of The Amazing Race Canada, Season 8). Participants will be provided with four (4) multiple choice answers, and upon choosing their answer a pre-populated tweet will be sent from the participant as a reply to @ChevroletCanada. Quiz answers can be submitted at any time during the Contest Period, although only one (1) answer per quiz question may be submitted. Each correct answer to a quiz question will result in one (1) entry into the Contest provided, however, that in order for a correct answer to result in an entry into the Contest, the individual must have correctly answered at least 3 of the 11 available quiz questions throughout the Contest Period; if this minimum is not met, the individual will not receive any entries into the Contest. For example, if at the end of the Contest Period an individual only answers 2 quiz questions correctly, the individual will not receive any entries into the Contest; however, if at the end of the Contest Period an individual has answered between 3-11 quiz questions correctly, the individual will receive the corresponding number of entries into the Contest based on the number of quiz questions answered correctly. Maximum of eleven (11) entries per person (if all quiz questions are answered correctly within the Contest Period). For certainty, an individual does not need to submit an answer to all 11 quiz questions to be eligible to receive entries (however, as set out above, an individual must correctly answer at least 3 quiz questions to be eligible).

    All entries must be submitted from a valid Twitter account. The potential winner may also be requested to provide the Sponsor with reasonable proof that they are the Authorized Account Holder of the Twitter account associated with the selected entry. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the Authorized Account Holder in whose name the Twitter account is registered, provided that person meets all other eligibility criteria of this Contest. "Authorized Account Holder" shall mean the natural person assigned to a Twitter account by Twitter.

  5. Prize: There is one (1) prize consisting of one (1) 2022 Chevrolet Bolt EUV (the “Vehicle Prize”), with a manufacturer's suggested retail price (“MSRP”) of up to $40,198 CAD to be awarded to one confirmed Contest winner (the “Winner”). The Vehicle Prize shall include destination/freight charges. Colour, accessories, and other specifics of the Vehicle Prize will be at the Sponsor’s sole discretion. Manufacturer's standard New Vehicle Limited Warranty in accordance with the terms and conditions applicable thereto, if any, applies to the Vehicle Prize. Upon notification, the Winner will personally take delivery of the Vehicle Prize from an eligible Chevrolet EV dealership within Canada closest to the Winner's primary residence as designated by the Sponsor (in its sole discretion); delivery must take place within two (2) months of being declared the Winner. Winner must present adequate personal identification (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) to claim the Vehicle Prize vehicle. The Vehicle Prize will not be released unless the Winner first shows proof of having a valid and unencumbered driver's license in the province or territory in which they reside and satisfactory insurance, as determined by the Sponsor. Winner is solely responsible for all taxes and expenses which are not included in the Vehicle Prize description above, including but not limited to: registration and license fees, insurance, accessories and all other costs incurred in claiming, registering or using the vehicle, obtaining a valid driver’s license, license plates, registration, insurance and/or fuel; and/or (d) taking delivery of the Vehicle. Winner is responsible for all costs associated with any upgrade or option packages they may request and which the Sponsor, in its sole discretion, is willing to provide or has provided respecting any vehicle. Any costs or expenses incurred by the Winner in claiming or using the Vehicle Prize will be the responsibility of the Winner. Vehicle Prize must be accepted as described in these Contest Rules and cannot be transferred to another person, substituted for another prize, or exchanged in whole or in part for cash. IMPORTANT NOTE: THE MSRP OF THE VEHICLE PRIZE AS NOTED ABOVE IS CURRENT AS OF [June 22nd 2022]. UNDER NO CIRCUMSTANCES WHATSOEVER WILL ANY DIFFERENCE BETWEEN THE ACTUAL RETAIL VALUE OF THE VEHICLE AS AT THE TIME OF PRIZE FULFILMENT OR ANY OTHER TIME AND THE MSRP OF THE VEHICLE NOTED ABOVE BE AWARDED. FOR THE AVOIDANCE OF ANY DOUBT, THE PRIZE CONSISTS OF THE VEHICLE AND NOT THE ACTUAL VALUE OF THE VEHICLE.

  6. Selection of Winner and Odds of Winning: A random draw will be held on October 10th 2022 at approximately 12:00PM ET in Toronto from all eligible entries received during the Contest Period. The odds of winning will depend on the number of eligible entries received during the Contest Period. The selected winner will be notified following the draw by a response Tweet from the Sponsor, directing the selected winner to direct message @ChevroletCanada as set out below. The selected winner is solely responsible for ensuring they are able to receive such notification message.

  7. Awarding of Prize: NO ONE IS THE WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS THEM AS THE WINNER IN ACCORDANCE WITH THESE RULES. To be declared the Winner, the selected entrant must, in addition to meeting the Contest eligibility criteria and otherwise complying with these Rules, first:

    (a) Be reached by response Tweet directing user to direct message @ChevroletCanada, which must be done within three (3) days immediately following the response Tweet (for certainty, the selected entrant must direct message @ChevroletCanada within this time in accordance with any instructions provided);
     
    (b) Be able to prove the validity of their Twitter account;
     
    (c) Have a valid unencumbered driver’s license in their province or territory of residence and satisfactory insurance at the time the Vehicle Prize is awarded;
     
    (d) Have correctly answered a mathematical skill-testing question, without mechanical or other aid, to be administered via the declaration and release documentation or by email, as determined by Sponsor; and
     
    (e) Sign and have witnessed the Sponsor’s declaration and release documentation and return it to the email address indicated in the documentation and received by the time indicated by the Sponsor or its representatives.
     
    The selected entrant must provide validity of their Twitter account, correctly answer the mathematical skill-testing question, and provide a completed declaration and release to the Sponsor or its representatives within [five (5) days] of the Sponsor or its representatives requesting such information.

    If any one of the conditions mentioned in these Rules is not met, the selected entrant will be disqualified and shall not be entitled to receive any prize (including without limitation the Vehicle Prize), and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select at random another eligible entrant as a potential prize winner (in which case, all foregoing potential prize winner notification and confirmation procedures will apply to such newly selected potential prize winner, with any necessary amendment) or to cancel the Vehicle Prize (which for greater certainty will in such case not be awarded).

  8. Delivery of Prize:  The Vehicle Prize will be awarded at the eligible Chevrolet EV dealership closest to the Winner’s primary place of residence, as determined by Sponsor (in its sole discretion). The Vehicle Prize must be accepted by the Winner (including without limitation personally claimed from the dealership noted above) in accordance with these Rules within two (2) months of the Winner being declared the Winner, failing which the Winner will be disqualified (and, if disqualified will forfeit any and all rights to the Vehicle Prize) and the Sponsor may in its sole and absolute discretion select at random another eligible entrant as a potential prize winner (in which case, all foregoing potential prize winner notification and confirmation procedures will apply to such newly selected potential prize winner, with any necessary amendment) or cancel the Vehicle Prize (which for greater certainty will in such case not be awarded).

  9. General Terms and Conditions:  

(a)  Verification of Entries: The validity of any entry and eligibility of any entrant is subject to verification by the Sponsor at any time and for any reason. Any entries that are illegible, incomplete, fraudulent or otherwise non-compliant with these Rules (all as determined by the Sponsor in its sole and absolute discretion), will be disqualified. Any entrant or other individual who enters or attempts to enter the Contest in a manner that is contrary to these Rules or that is otherwise disruptive to the proper operation of the Contest or by its nature is unjust to other entrants or potential entrants (all as determined by the Sponsor in its sole and absolute discretion) will be disqualified. All decisions made by the Sponsor or its representatives, including without limitation those concerning the eligibility or disqualification of entrants, are final and binding without right of appeal. All entries become the property of the Sponsor and none will be returned.
 

(b)  Acceptance of Prize:  The Vehicle Prize must be accepted as described in these Rules and cannot be returned, transferred to another individual, substituted for another prize or exchanged in whole or in part for money. The Sponsor does, however, reserve the right, in its sole and absolute discretion, and for any reason whatsoever, to substitute the Vehicle Prize, or part thereof, another prize of equivalent or greater value, including, without limitation, a cash award.
 

(c)  Number of Prizes/Winners:  By entering the Contest, each entrant acknowledges that the Sponsor shall not be required under any circumstances to award more prizes than the number of available prizes, as set out in these Rules (i.e., the one (1) Vehicle Prize). In the event that, for any reason whatsoever (including, without limitation, as a result of an error, malfunction or defect in the design, advertising, management, implementation or administration of the Contest, whether mechanical, electronic, human or otherwise) the number of declared winners or the number of prizes claimed by entrants is greater than the number of prizes available (i.e., the one (1) Vehicle Prize), subject to approval by the Régie des alcools, des course et des jeux (the “Régie”), the Sponsor reserves the right, in its sole and absolute discretion, to end the Contest in whole or in part, without notice, and to award the correct number of prizes (i.e., the one (1) Vehicle Prize) to a Winner, selected in accordance with these Rules from among those entries validly submitted prior to the termination of the Contest.
 

(d)  Late/Lost Entries:  Sponsor is not responsible for, (i) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen or illegible entries; or (ii) failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient.
 

(e)  Other Changes to Contest Rules:  The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in the Province of Québec, to the extent applicable, to modify, cancel, terminate, suspend or amend this Contest, in whole or in part, at any time and in any way, without prior notice (including, without limitation, in the event of any virus, computer bug or unauthorized human intervention or any other cause that is beyond the control of the Sponsor, that could corrupt or affect the administration, security, impartiality or normal course of the Contest). Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, such as tampering, the Sponsor reserves the right with the consent of the Régie, to cancel the Contest. The Contest Group, their shareholders, Twitter, Inc., and the Program Parties (collectively, the “Releasees”) shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest, including, but not limited to, any damage to an individual’s mobile phone, computer equipment, system, software or any combination thereof, as a result of the individual’s participation in this Contest. Further, the Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by Sponsor, for purposes of verifying compliance by any participant, entry and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
 

(f)  Release and Exclusion of Liability by the Entrants:  By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees: (i) to release, discharge, and forever hold harmless the Releasees from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant’s participation or attempted participation in the Contest, compliance or non-compliance with these Rules and acceptance and use of the Vehicle Prize. Any entrant selected for a prize acknowledges that upon awarding of the Vehicle Prize, the obligations typically borne by the provider of services or goods become that provider’s responsibility; and (ii) if selected as a potential winner, to sign the Sponsor’s declaration and release documentation in this regard before receiving their Vehicle Prize. The Releasees will not be responsible for lost, incomplete, late or misdirected entries or for any failure of any website and/or platform (including without limitation, Twitter), if applicable, during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting death, injury or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
 

(g)  Conduct:  By participating in the Contest, each entrant agrees to be legally bound by these Rules. The entrant agrees to be bound by any decision of the Sponsor in connection with the Contest (including without limitation in respect of correct versus incorrect answers to trivia questions), which will be final and binding in all respects. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant found to be: (a) violating these Rules; and/or (b) tampering or attempting to tamper with the entry and registration process, the operation of the Contest, or any of the Sponsor’s websites. Winner must at all times behave appropriately when taking part in the Contest, the Vehicle Prize and any media obligations and must observe these Rules and any other rules or regulations in force online, and/or in any other medium, as applicable.
 

(h)  Name/Image of Winner:  By entering the Contest, the Winner authorizes the Sponsor and its advertising and promotional agencies and their respective employees or other representatives to broadcast, publish and otherwise use their name, photo, image, statements regarding the Contest or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration.
 

(i)  Personal Information:  By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy. The personal information collected about entrants in connection with this Contest will be used solely for the administration of the Contest and to fulfill the prize, unless the entrant has provided additional consent to have their personal information used by the Sponsor. A copy of the Sponsor’s privacy policy is available at www.gm.ca/privacy.
 

(j)  The Contest is in no way sponsored, endorsed or administered by, or associated with Twitter. The entrant provides personal information to the Sponsor, not to Twitter. Twitter is completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Twitter.

(k)  This Contest is in not sponsored, administered, or managed by Bell Media Inc., The Amazing Race Canada (the “Program”) producer Insight Production Company Ltd., or the format owner of the Program (collectively the “Program Parties”). Each of the Program Parties is released of any and all liability with respect to the Contest and prizing.

(l)  Discrepancies:  In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to: the French version of these Rules, the Contest-related Twitter posts, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

(m)  Legal Residents of Quebec Only:  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
